About these terms
Rishav Explains is a business registered in Nepal, operating www.rishavexplains.com.
These Terms and Conditions (the “Terms”) are a binding agreement between you and Rishav Explains (“we”, “us”, “our”) for using www.rishavexplains.com and buying its programs. By registering, buying, or otherwise using the site, you accept these Terms. If you don't accept them, please don't use the site.
These documents form part of the Terms and apply alongside them:
- Learner Account Policy: registering, logging in and account rules.
- Refund Policy: when and how refunds are given.
- Privacy Policy: how we handle your personal data.
- Software License: how the software behind the site is licensed.
Definitions
- Site: www.rishavexplains.com and the services on it.
- Program: any course, blueprint, training, tip pack or prompt pack offered on the Site, including its lessons, videos, files and text.
- Learner or you: anyone who registers on or uses the Site.
- Order: a request to buy one or more Programs, identified by a number starting RE-.
- Content: everything on the Site, including Programs, text, images, video, audio, prompts, templates and design.
Who can use the site
You must be at least 16 years old, or use the Site with a parent or guardian who registers, buys and accepts these Terms on your behalf. By using the Site you confirm you can form a binding contract under the law that applies to you.
Your account
You need an account to buy and take Programs. The rules for registering, logging in, keeping your account secure, and the ban on sharing accounts are set out in the Learner Account Policy. You are responsible for keeping your login details private and for activity on your account.
Orders and pricing
- Prices are in Nepali rupees (NPR). Any discount is shown before you pay, and the total at checkout is what you pay.
- Where tax applies, it is charged as the law requires.
- Placing an order is an offer to buy. A contract is formed only when we confirm your payment and the Program is added to your account.
- We try to keep prices and descriptions accurate. If there is an obvious error, we may cancel the order and refund you in full, or offer the Program at the correct price.
- Prices may change at any time, but a change never affects an order already confirmed.
Payment and confirmation
- You pay with the method you choose at checkout, such as eSewa, Khalti or IME Pay. Your payment provider's own terms also apply to the payment.
- We never see or store your wallet PIN or card number.
- At present, payments are checked and confirmed by our team. Your Program unlocks on your account once payment is confirmed; you can follow its status in My learning.
- We may decline or cancel an order whose payment can't be verified or appears fraudulent. Any amount received is refunded.
Refunds and cancellations
You can get a full refund on a Program if you ask within 7 days of your order being confirmed and have completed less than 20% of its lessons. Duplicate payments and orders we can't fulfil are always refunded, and a pending order can be cancelled before it's confirmed. Refunded Programs are removed from your account.
The full rules, exceptions and how to ask are in the Refund Policy.
Your licence to programs
When an order is confirmed, we give you a personal, non-exclusive, non-transferable, revocable licence to access and use the Programs you bought, on your own account, for your own learning, for as long as we offer them on the Site. You may use what you learn, and prompts and templates from a Program, in your own work, including commercial projects.
You may not:
- Share, sell, rent, lend, sublicense or transfer a Program or your access to it.
- Download, record, screen-capture, copy or re-upload lessons or paid materials.
- Publish, resell or give away prompts, templates or files as a collection or product of their own.
- Use a Program, or its Content, to create a competing course, program or product.
- Remove copyright, ownership or licence notices.
Intellectual property
The Site and all Content, including Programs, videos, text, prompts, templates, graphics, logos and the “Rishav Explains” name, belong to Rishav Explains or its licensors and are protected by copyright, trademark and other intellectual-property laws. Buying a Program gives you the licence above; it doesn't transfer ownership of anything. All rights not expressly granted are reserved.
The software that runs the Site is licensed separately, as explained on the Software License page.
Acceptable use
You agree not to:
- Break any law, or use the Site for anything fraudulent, harmful or misleading.
- Access, or try to access, accounts, data or parts of the Site you're not authorised to use.
- Interfere with or disrupt the Site, including by scraping, overloading it, or getting around its security or limits.
- Reverse-engineer, decompile or copy the Site's software.
- Upload or send viruses, spam, or content that is abusive, hateful, defamatory or infringes others' rights.
- Impersonate anyone, or misrepresent your connection to anyone.
Reviews and messages
You keep ownership of reviews and messages you send us, and you give us a free, worldwide, non-exclusive licence to display your reviews (with the name you give) on the Site and to use them to promote the Programs. Reviews must be honest and based on your own experience. We check reviews before publishing them and may decline or remove any that break these Terms.
Third-party services
Some features rely on others, such as payment providers, and some lessons may play from services like YouTube or Vimeo. Their own terms apply to your use of them, and we're not responsible for their services. Links to other websites are provided for convenience only.
Availability and changes to programs
We aim to keep the Site available and running smoothly, but it may sometimes be unavailable for maintenance, updates or reasons outside our control. We may update, improve or reorganise Programs to keep them accurate and current. If we have to stop offering a Program you bought, we'll give you reasonable notice to finish it or a fair refund.
Disclaimers
Programs are educational. They share knowledge and experience; they are not professional, financial, legal, tax or career advice. Results depend on you, and we don't guarantee any particular outcome, such as income, followers, clients or a job.
Apart from the promises in these Terms, the Site and Content are provided “as is” and “as available”. To the extent the law allows, we make no other warranties, including that the Site will be uninterrupted or error-free.
Limitation of liability
To the fullest extent the law allows:
- We're not liable for indirect, incidental, special or consequential loss, or for loss of profit, income, business, data or goodwill.
- Our total liability to you for all claims relating to the Site or Programs is limited to the amount you paid us in the 12 months before the claim arose.
Nothing in these Terms limits liability that can't be limited by law, including for fraud, or your rights under consumer protection law.
Indemnity
You agree to compensate us for reasonable losses and costs, including legal fees, that result from your breach of these Terms or misuse of the Site, such as sharing or reselling Programs.
Suspension and termination
You can stop using the Site and ask us to close your account at any time. We may suspend or close your account, or remove access to Programs, if you seriously or repeatedly break these Terms or the Learner Account Policy, if required by law, or to protect other learners or the Site. Where a closure is caused by your breach, no refund is due. Sections that by their nature should continue, such as intellectual property, disclaimers and limitation of liability, survive termination.
Events beyond our control
We're not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, power or internet outages, strikes, government action, or failures of third-party services. We'll do what we reasonably can to limit the effect on you.
Changes to these terms
We may update these Terms, for example when we add features or the law changes. The date at the top shows the latest version. For significant changes, we'll tell you on the Site before they take effect. Continuing to use the Site after a change means you accept the updated Terms. Orders already confirmed stay under the Terms that applied when you placed them.
General
- Whole agreement. These Terms, with the documents linked above, are the whole agreement between you and us about the Site.
- Severability. If any part is found invalid, the rest stays in force.
- No waiver. If we don't enforce a right straight away, we can still enforce it later.
- Transfer. You may not transfer your rights under these Terms. We may transfer ours, for example if the business is reorganised, without reducing your rights.
- Notices. We may send notices to the mobile number or email on your account, or show them on the Site.
- Language. These Terms are written in English; if a translation differs, the English version applies.
Governing law and disputes
These Terms are governed by the laws of Nepal. If you have a problem, please contact us first; we'll try in good faith to resolve it within 30 days. If we can't, the dispute will be decided by the competent courts of Nepal. This doesn't stop you using any consumer protection rights available to you where you live.
